If you own or manage HUD properties, you will want to read the latest guidance from HUD’s Office of Fair Housing and Equal Opportunity (FHEO) that applies to the more than 1.5 million HUD-subsidized multifamily units nationwide, including Project-Based Rental Assistance, Section 202, and Section 811.
The new guidance reinforces requirements that HUD-subsidized multifamily housing’s marketing and application processes are designed to be inclusive of people of all races and national origins. The new guidance applies to the more than 1.5 million HUD-subsidized multifamily units nationwide, including Project-Based Rental Assistance, Section 202, and Section 811.
The announcement included the release of two new pieces of guidance, “Guidance on Compliance with Title VI of the Civil Rights Act in Marketing and Application Processing at Subsidized Multifamily Properties” and “Implementation Sheet for HUD’s Title VI Guidance.” The guidance describes how HUD’s marketing, rental application processing, and waitlist management practices can violate Title VI of the Civil Rights Act, a law prohibiting intentional discrimination on the basis of race, color, and national origin in programs or activities receiving federal financial assistance. The guidance also includes information for housing providers on exclusionary practices to avoid and offers ways to ensure that HUD programs are equitable.
